TERMS & CONDITIONS OF SALE

These terms govern work performed by Rivo Electric. The plain-language version of the warranties below — what they cover, how to claim, and what they cap — is at /guarantee. The two say the same thing; this is the version that governs.

LIMITED WARRANTY AND REMEDIES

Effective on the date of the invoice.

LIMITED WARRANTY — WORKMANSHIP

Rivo Electric warrants its workmanship against defect for twenty-four (24) months from the date the work is completed.

LIMITED WARRANTY — PRODUCTS

Rivo Electric warrants the products, parts and materials it supplies and installs against defect for ten (10) years from the date the work is completed. This warranty is given by Rivo Electric directly and is not contingent on, or limited by, any warranty offered by the manufacturer. Where a manufacturer warranty also applies, it is in addition to this warranty and Rivo Electric will assist the Customer in claiming under it. Consumable items are excluded.

HOW TO CLAIM

Notify Rivo Electric of a defect within the applicable warranty period — twenty-four (24) months for workmanship, ten (10) years for products — by telephone or in writing. Notice by telephone is sufficient; Rivo Electric will confirm it in writing.

REMEDY

Rivo Electric will repair the defective workmanship or product at no charge. If Rivo Electric is unable to repair the defect after a reasonable opportunity to do so, Rivo Electric will, at the Customer's election, either replace the defective work or product or refund the amounts paid for the affected portion of the work. Where a product is no longer manufactured or available, Rivo Electric may supply a functionally equivalent replacement. The total amount recoverable under these warranties shall not exceed the amount the Customer paid Rivo Electric for the affected work or product.

EXCLUSIONS

These warranties do not cover: work altered or repaired by anyone other than Rivo Electric; damage caused by flood, fire, lightning, power surge, vermin, or other causes outside Rivo Electric's control; materials or products supplied by the Customer; or normal wear of consumable items including bulbs, batteries and filters.

TRANSFER

These warranties extend only to the Customer named on the invoice and are not transferable to any subsequent owner or occupant of the property.

Nothing in these terms limits any right the Customer has under the New Jersey Consumer Fraud Act or any other law that cannot be waived by agreement.
